White House Issues Executive Order Lifting Tariffs on Certain Agricultural Goods from Brazil

On November 20, 2025, the White House announced in an Executive Order 14323 that certain agricultural goods from Brazil will no longer be subject to the International Emergency Economic Powers Act (IEEPA) 40% tariff.  This action is retroactive to November 13, 2025, at 12:01 a.m. Eastern Standard Time.  Annex I and II of Executive Order 14323 have been modified to reflect these changes.  You can view the updated annexes at 2025 November Brazil Tariff. U.S. Customs and Border Protection (CBP) confirmed in its notice that 238 agricultural HTSUS codes have been added to Annex I, which identifies the products to which the Brazil tariffs do not apply.  Additionally, agricultural products that meet the requirements of the eleven additional categories are now exempt from Brazil tariffs. 

CBP directed customs brokers and importers to utilize the following HTSUS subheading when making declarations to claim these exemptions: 

  • 9903.01.81 – For goods exempt from Brazil tariffs under Annex I
  • 9903.01.90 – For goods described in one of the eleven categories of agricultural goods
