Agricultural Exemptions Issued for Reciprocal Tariffs

On November 13, 2025, the White House issued an Executive Order exempting certain agricultural products from reciprocal tariffs, effective immediately.  U.S. Customs and Border Protection (CBP) will process refunds for entries made on or after November 13, 2025, at 12:01 a.m. EST.

CBP confirmed in CSMS # 66814923 this action affects “237 agricultural HTSUS classifications, and eleven additional categories of agricultural products”.  Annex II of Executive Order 14257 was amended and now identifies the products to which the reciprocal tariffs do not apply.  You can view Annex II here.

The Fact Sheet issued by the White House states that “certain agricultural products shall no longer be subject to the reciprocal tariffs.  Some of these products include:

  • Coffee and tea.
  • Tropical fruits and fruit juices.
  • Cocoa, and species.
  • Bananas, oranges, and tomatoes.
  • Beef; and
  • Additional fertilizers.

CBP instructed customs brokers to apply the following HTSUS subheadings when declaring goods.

9903.01.32 Use for goods exempt from reciprocal tariffs (except specified categories)

9903.02.78 Use for goods in the affected categories, including:

  • Etrogs, tropical fruit, date palm branches (religious use)
  • Bread, pastry, cakes, biscuits, baker’s wares
  • Communion wafers, empty capsules (pharmaceutical use)
  • Acai, citrus juice, coconut water, acai preparations for beverages
  • Essential oils for religious purposes
